UPDATED: April 2024 – Be sure to read through the Terms of Service for REI Grow, so there is no confusion about the service we make available to you. We at REI Grow may update our Terms of Service at any time, and when we do, they will be available on our website. Your ongoing use of your REI Grow website following an update confirms your consent to the update. Any new features that REI Grow releases are subject to these terms. Violation of any of the terms may result in the termination of your account. By using REIGrow.com (“Service”), you agree to be bound by the following terms and conditions:

Using Your REI Grow Website(s) and REI Grow Service

You agree and warrant that you will not use the website to: Conduct business that is illegal in your state. Post anything that is false, fraudulent, or misleading Post anything that is unlawful, threatening, abusive, libelous, defamatory, or sexually explicit. Post anything that does not belong to you, that you do not have the legal right to post, or that impersonates someone else. Send any unsolicited advertisements (SPAM) Reproduce, duplicate, copy, sell, resell or exploit any portion of the website. You are required to provide your legal full name, a valid email address, and any other information requested in order to maintain service. You are responsible for all content posted and activity that occurs under your account. The account owner may only use your login. A single login shared by multiple people (even within your company or organization) is not permitted. You are responsible for the security of your account, including your password. We are not liable for any loss or damage from your failure to maintain a strong and private password. Use of REI Grow Content On Non-REI Grow Websites Is Prohibited. You agree not to post REI Grow content on another platform or website. Posting any of our stock website content on any website outside of our system is prohibited. We will pursue any website hosting any of our copyright-protected content with a request to cease and desist and/or we will pursue every measure possible including requesting the web host to remove the website containing the protected material.

REI Grow provides website backup on a regular basis, however, it is still a good idea to keep a copy of any content you produce in a separate location. As part of backup and maintenance, your content may be transferred unencrypted over various networks. REI Grow is not responsible for loss of content. We are not liable for the accuracy of content posted on your website(s). Any agreements you make with others through the website are strictly between you and the third party. Investigate appropriately before dealing with someone you do not know. We are not responsible or liable for any claim, loss, or damage, of any kind related to your use of the website. Your site may be used by REI Grow for marketing or other purposes without payment or any other consideration to you. You may not remove our branding from your account. If your bandwidth usage significantly exceeds the average bandwidth usage of our customers, we reserve the right to immediately disable your account or throttle your file hosting until you reduce your bandwidth consumption.

We may collect information you provide to us. We may share your personal information if required to do so by law or in order to enforce these terms. YOU ARE USING THE WEBSITE ENTIRELY AT YOUR OWN RISK. THE WEBSITE IS PROVIDED ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES DUE TO YOUR USE OF THE WEBSITE.

Our Legal Terms shall be treated as though it were executed and performed in the State of Texas, within the United States and shall be governed by and construed in accordance with the laws of Texas without regard to conflict of law principles. IF YOU ARE DISSATISFIED WITH THE WEBSITE, YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, OR HAVE ANY OTHER DISPUTE OR CLAIM WITH US OR ANOTHER USER OF THE WEBSITE, YOUR SOLE AND EXCLUSIVE REMEDY AGAINST US IS TO DISCONTINUE USING THE WEBSITE. OUR LIABILITY RELATED TO YOUR USE OF THE WEBSITE IS LIMITED TO $100 IN THE AGGREGATE FOR ALL CLAIMS. ANY CLAIM YOU MAY HAVE RELATED TO YOUR USE OF THE WEBSITE MUST BE COMMENCED BY FILING SUIT IN Travis County, Texas, WITHIN ONE (1) YEAR OF THE EVENT UPON WHICH THE CLAIM IS BASED FIRST OCCURRED.

You agree to indemnify and hold us harmless from any claim or demand, including attorney fees and court costs, made by any third party related to your use of the website. REI Grow reserves the right to adjust pricing of plans and/or services at any time, which includes but is not limited to existing user accounts and/or new user accounts. As with any other expense in your business, as we improve and innovate on our product we incur more expenses to create a better and better tool for your business. We do not screen any content you post. We do have the right, in our sole discretion, to remove any content from the website. We do not allow the creation of forms or other material that would capture and store sensitive information on the sites including but not restricted to Credit Card information or Social security numbers. If we fail to exercise or enforce any right or provision of the terms, we do not waive that right or provision.

These terms constitute the entire agreement between us and govern your use of the website, superseding any prior agreements between us (including, but not limited to, any prior versions of the Terms of Service). Your account may be terminated at any time for violation of these terms. In the event your account is terminated, no refund will be due to you. Termination will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. By using REI Grow, you agree to allow our team to proactively run tests using your website with the intention of improving conversion rates over the long-term, with or without notice.

Limited License And Prohibited Uses

REI Grow grants you a personal, royalty-free, non-assignable, revocable, and non-exclusive license to access and use the Platform Content while using the Platform. Except to make the Services available to you and your end users, as expressly permitted under these Terms of Service, any other use, including the reproduction, modification, distribution, transmission, republication, framing, display or performance of Platform Content without prior permission of REI Grow is strictly prohibited. You may not remove any Marks or other proprietary notices, including, without limitation, attribution information, credits, and copyright notices that have been placed on or near the Platform Content.

You, your employees, and your end-user clients (“Clients”) may use the Platform only for lawful purposes and in accordance with these Terms of Service. You agree that you, your employees, and your Clients will not:

Use the Platform or any Services in any way that violates any applicable law or regulation. Use the Platform or any Services for the purpose of exploiting, harming or attempting to exploit or harm anyone in any way. Send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms of Service. Transmit or procure the sending of, any unlawful advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation. Impersonate or attempt to impersonate REI Grow, a REI Grow employee, another user or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing). Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Platform or any Services, or which, as determined by REI Grow, may harm REI Grow or users of the Platform or expose them to liability.

Use the Platform or any Services in any manner that could disable, overburden, damage, or impair the Platform or interfere with any other party’s use of the Platform, including their ability to engage in real time activities through the Platform. Use any robot, spider or another automatic device, process, or means to access the Platform for any purpose, including monitoring or copying any of the material on the Platform. Use any manual process to monitor or copy any of the material on the Platform or for any other unauthorized purpose without REI Grow’s prior written consent. Use any device, software, or routine that interferes with the proper working of the Platform or any Services. Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, any server, computer, or database connected to the Platform, or any Services. Attack the Platform via a denial-of-service attack or a distributed denial-of-service attack. Otherwise, attempt to interfere with the proper working of the Platform or any Services.

Customer/End User Conduct

In connection with your use of the Platform or Services, you agree that:

You, your employees, agents, and Clients will maintain in effect all licenses, permissions, authorizations, consents, and permits necessary to carry out the obligations under these Terms of Service. You are fully responsible for your actions and the actions of your employees, agents, and Clients with respect to use of the Platform. You are fully responsible for the use of the Services by your Clients. REI Grow’s agreement is with you, not your Clients. You, your employees, agents, and Clients will not misrepresent the Services. You will provide these Terms of Service to your employees, agents, and Clients and confirm that all employees, agents, and Clients understand that they are subject to these Terms of Service if they use or offer the Services. You own or control all rights in and to all content you provide to REI Grow.

You will be solely responsible for all of your use of the Platform, including the quality and integrity of any data and other information made available to us by or for you through the use of the Services under these Terms of Service and each Service that you make available to your Clients. You have provided, and will continue to provide, adequate notices and have obtained, and will continue to obtain, the necessary permissions and consents to provide your Client’s data to us for use and disclosure in accordance with these Terms of Service and our Privacy Notice. You, your employees, and your Clients will provide reasonable cooperation regarding information requests from law enforcement, regulators, or telecommunication providers.

Your Use Of Communications Features of the Services

REI Grow is the provider of Services for your use, which may include certain communications features such as SMS, MMS, email, voice call capabilities, and other methods. You agree that:

You are exclusively responsible for all communications sent using the Services, including compliance with all laws governing those communications, such as the Telephone Consumer Protection Act (“TCPA”) and the CAN-SPAM Act. You agree that you understand and will comply with those laws. You understand that using the Services may violate applicable laws if you do not comply with them. REI Grow is not responsible for your compliance with laws and does not represent that your use of the Services will comply with any laws. You should consult a lawyer for legal advice to ensure your communications comply with applicable law. REI Grow is a technology platform communication service application provider only. REI Grow does not originate, send, or deliver any communications to any recipient via SMS, MMS, email, or another communication method; You, not REI Grow, are the maker or initiator of any communications. You control the message, timing, sending, fraud prevention, and call blocking. The Service is purely reactive and sends messages only as arranged and proscribed by you. All communications, whether, without limitation, SMS, MMS or email, are created by and initiated by you and/or your Clients, whether generated by you or sent automatically via the Services at your direction. Any customer data provided to REI Grow through any means, including without limitation, by inbound text, data imports, tablet sign-ins, API calls, or manual entry, only includes data from individuals who have explicitly opted into your communications program and have explicitly agreed to receive your communications (whether by SMS, MMS, email, voice communication or another method) in accordance with applicable law, including without limitation the TCPA.

Excessive Data Usage

Your excessive data use may cause the Service to be slow or unavailable. We have no liability for the effect that your excessive data use may have on Service performance. We may (1) suspend or terminate your use of the Service or (2) reduce the amount of data you are able to use, with or without advance notice, if we determine in our sole discretion that your data use is excessive, abusive or has a negative effect on the Services in any way.

Search Engine Optimization

You understand and accept that the results of search engine optimization are not guaranteed due to certain factors being outside our control. Search engines frequently change their search algorithms which may impact your results. You understand and accept that you may see no improvement of your website rankings or that there is the chance of a search engine not including your website in their search index.

Trial, Payment, Upgrading, and Downgrading Accounts

A valid credit card is required to sign up for an REI Grow account. You will be charged for the first month when you sign up. All monthly fees are due in advance on a monthly basis. If your card is declined and your credit card is not updated within 10 days, we reserve the right to cancel your account and deactivate your sites. Our system will continue automatically attempting to process an active account’s overdue invoices for 30 days. REI Grow will attempt to communicate if your account is in arrears. Communications include, but are not limited to, email, chat, sms /text, phone calls, and ring less voicemails. Once the account has been delinquent for 30 days, any site(s) under your account will immediately be unavailable, and all content will be permanently deleted. If you have chosen the option to pay one annual payment for your subscription, the renewal and cancellation policy is the same as above.

You have a full 30 days to try out your account and cancel within that time to receive a full refund, per these terms. There are no pro-rated refunds on annual accounts if you cancel more than 30 days after the initial purchase. Each customer is entitled to only one (1) refund under our 30-day guarantee. If you sign up and cancel within 30 days of signing up and receive a refund, then sign up later, you’re not eligible for a refund if you cancel again within the first 30 days. Each customer is limited to one special or discount upon signing up for a subscription. For any upgrade or downgrade in plan level, your credit card will automatically be charged the new rate on your next billing cycle. Downgrading your account may cause a loss of content, features, or capacity of your account. We do not accept any liability for such loss. Sales Tax. All fees are exclusive of taxes, which we will charge as applicable. You agree to pay any taxes applicable to using the Subscription Service. You shall have no liability for any taxes based upon our gross revenues or net income.

The REI Grow Usage Pricing:

Our billing system includes a credit-based model, where users are charged for their usage of inbound and outbound communications within the REI Grow platform. Each communication activity, including SMS messages, emails, phone number purchases, voice calls, AI usage, and other usage based interactions, incurs a specific credit charge. These credits are tracked and deducted from the user’s account balance after each usage. Please note that usage credits are NON_REFUNDABLE once purchased. By using our services, users agree to abide by our billing terms and acknowledge their responsibility for maintaining a sufficient credit balance to cover their usage.

How credits can be added:

Users can add credits by going into Settings > Company Billing of their REI Grow App. Users have the option to add credits to their account. Credits are charged as a lump sum (For Example $10).

How credits are deducted:

Credits are deducted per execution (For Example: $0.0050/email sent to a contact). Once all the credits are utilized in the user’s account. REI Grow’s automated system will attempt to charge the card on file for the amount set in the Company Billing section.

Cancelation Policy

Thank you for choosing our services. We understand that plans can change, and we aim to make the cancellation process as straightforward as possible for our users. Please carefully review our cancellation policy below to ensure you understand the process and conditions.

How to Cancel Your Subscription

To cancel your subscription, please complete the cancellation form available at https://on.reigrow.com/sorry-to-see-you-go. This is the only method by which subscription cancellations will be processed.

Important: Requests for subscription cancellations via email, phone call, voicemail, or our ticket portal will not be accepted. If you attempt to cancel your subscription through these channels, our staff will kindly redirect you to the cancellation form link provided above.

Non-Refundable Services

Please be aware that certain services, once purchased, are non-refundable. These include:

• Individual Services: Services such as lead & skip tracing, and custom website design are final sale and cannot be refunded once purchased.
• Monthly Add-On Services: While you may cancel monthly add-on services like SEO optimization and social media management at any time, please note that these services are not refundable.

Processing Your Cancellation

Upon receipt of your completed cancellation form, our team will process your request as quickly as possible. We appreciate your patience during this time and will confirm your cancellation once it has been finalized.
